3.3 You need to be competent in the relevant software required to use our products and/or services. We reserve the right to limit support not relating to installing of our products and/or services.
4. RETURNS, REFUNDS AND CANCELLATIONS
Due to the digital nature of Webineerz poducts and/or services, all payments for Webineerz products and/or services are non-refundable except where the products and/or services are determined to be defective by Webineerz.
5. YOUR ACCOUNT
You agree to provide accurate and complete information when You register with, and as You use, the Webineerz Services, and you agree to update Your account information to keep it accurate and complete. You agree that Webineerz may store and use the information You provide for use in maintaining and billing fees to Your Account.
6. ACCESS TO PREVIOUS DIGITAL PURCHASES
As an accommodation to You, subsequent to acquiring Webineerz, you may download previously acquired digital purchases (when available). Some Webineerz products and/or services that You previously acquired may not be available for subsequent download or access at any given time, and Webineerz shall have no liability to you in such event. As you may not be able to subsequently download certain previously-acquired content or training, once you download an item, it is Your responsibility not to lose, destroy, or damage it, and You may want to back it up.
Webineerz reserves the right to change content options (including eligibility for particular features) or remove access without notice to any previously purchased training or content that is no longer valid or deemed out of date.
7. INTELLECTUAL PROPERTY
You agree that Webineerz, including but not limited to Webineerz products and services, graphics, user interface, audio clips, video clips, editorial content, templates and the scripts and software used to implement Webineerz Services, contains proprietary information and material that is owned by Webineerz and/or its licensors, and is protected by applicable intellectual property and other laws, including but not limited to copyright. You agree that you will not use such proprietary information or materials in any way whatsoever except for use of the Webineerz Services in compliance with this Agreement. No portion of the Webineerz Services may be reproduced in any form or by any means, without expressed written permission from Webineerz. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Webineerz Services in any manner, and You shall not exploit the Webineerz brand in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.
Notwithstanding any other provision of this Agreement, Webineerz and its licensors reserve the right to change, suspend, remove, or disable access to any Webineerz products, content, or other materials comprising a part of the Webineerz brand at any time without notice. In no event will Webineerz be liable for making these changes. Webineerz may also impose limits on the use of or access to certain features or portions of Webineerz services, in any case and without notice or liability.
All copyrights in and to Webineerz / Hysteresis Media Ltd. (including the compilation of content, postings, links to other Internet resources, and descriptions of those resources) and related software are owned by Webineerz and/or its licensors, who reserve all their rights in law and equity. THE USE OF THE SOFTWARE OR ANY PART OF Webineerz, EXCEPT FOR USE OF Webineerz AS PERMITTED IN THIS AGREEMENT, IS STRICTLY PROHIBITED AND INFRINGES ON THE INTELLECTUAL PROPERTY RIGHTS OF OTHERS AND MAY SUBJECT YOU TO CIVIL AND CRIMINAL PENALTIES, INCLUDING POSSIBLE MONETARY DAMAGES, FOR COPYRIGHT INFRINGEMENT.
Webineerz, the Webineerz logo, other Webineerz trademarks, service marks, graphics, and logos used in connection with Webineerz are trademarks or registered trademarks of Hysteresis Media Ltd. in the U.S. and/or other countries. Other trademarks, service marks, graphics, and logos used in connection with Webineerz Services may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.
You must not:
• Republish material from Webineerz
• Sell, rent or sub-license material from Webineerz
• Reproduce, duplicate or copy material from Webineerz
• Redistribute content from Webineerz

- The graphic assets used by Webineerz to showcase and/or promote Webineerz, any of our product and/or services or any of its other properties
- The verbiage used by Webineerz in original offerings, products, services, materials, and/or courses that is not explicitly stated by Webineerz representatives for student application and redistribution
